Is Part 108 currently law?
Not yet. As of September 15, 2026, the FAA is still developing the final rule.
Can I fly BVLOS today?
Possibly, but not simply because Part 108 has been proposed. Current BVLOS operations must comply with the existing FAA regulatory framework and obtain any required waiver, exemption, COA or other authorization.
Will Part 108 eliminate BVLOS waivers?
The purpose of Part 108 is to establish a standardized regulatory pathway that reduces reliance on individual exemptions and waivers for qualifying operations. The exact role of waivers under the final rule will depend on the final regulations.
Will Part 108 replace Part 107?
No. Part 107 will continue to govern operations that fall within its scope.
Will every Part 107 pilot be allowed to fly BVLOS?
No. Part 108 would establish additional requirements and authorization pathways.
Will Part 108 allow autonomous drones?
Part 108 is designed to facilitate increasingly automated BVLOS operations, but autonomy does not mean that all autonomous operations will automatically be authorized.
Will Part 108 allow drone delivery?
Package delivery is specifically identified as one of the intended applications of the proposed framework.
When will Part 108 become effective?
The date cannot yet be stated as final. The FAA is still completing the final rulemaking process.
